Terms and Conditions
ALL appointments will be subject to a fifty-dollar charge for any cancellations or rescheduling, if not done within 48 hours. Client must be present onsite before On the Way Mechanic does any diagnostic or repair work, if client is not on site On the Mechanic will leave the site and the appointment will have to be rescheduled with a fifty- dollar fee that must be paid upfront. If One the Way Mechanic must pursue collections for payment the client agrees to be responsible for any fees, charges, court cost, attorney fee, connected to this process. This warranty covers only the original purchaser and cannot be transferred. Parts and products are covered under a manufactures warranty only. Labor warranty is thirty days only after thirty days client is responsible for labor, tax, shipping and handling fees. Warranties do not apply to services performed on parts or products installed in vehicles used commercially or for racing or for off road purposes. Warranty will be void if the parts are modified, altered, abused, unreasonably used, damaged by accident, negligence or misuse. This warranty excludes transportation expense of a defected part or product to or from manufacture, compensation for inconvenience or loss of use while the service, part or product is being replaced, cost of rental car, reimbursement for time off work, loss of income, towing charges, telephone calls, property damage, loss of revenue, legal fees and cost, or other consequential or incidental damages. This warranty does not include a refund. On the Way Mechanic or employees are not responsible for damages to property while services are being performed on or off client’s property. Liability under this warranty is limited to the retail price of the service, part, or product at the time of purchase, and On the Way Mechanic, employee, or the manufacturer shall have no liability whatsoever for any consequential or incidental damages. The limited warranty above is the only express warranty made by On the Way Mechanic regarding such service, parts, or product. The duration of any warranty implied by law, including the warranties of merchantability and fitness for particular purpose, is limited to the duration of this express warranty. The foregoing warranties are exclusive and in lieu of all other remedies. Some states do not allow limitations on how long an implied warranty lasts or the exclusion or limitation of incidental or consequential damages, so the above limitations or exclusions may not apply to you. This warranty gives you specific legal rights and you may also have other rights which vary from state to state. If the client has a dispute or disagreement of any kind related to the services performed on the client’s vehicle by On the Way Mechanic or related to the terms or content of the invoice provided in connection with those services, by signing or otherwise accepting the terms of a On the Way Mechanic invoice, the client agrees that such dispute or disagreement will be resolved through binding arbitration. This means that the client and On the Way Mechanic are waiving the right to a jury trial or a trial before a judge in a public court. The only exception to this waver is that you and, On the Way Mechanic, retain the right to pursue in small claims court any dispute within that court’s jurisdiction. The client further agrees that all claims must be brought in your individual capacity, and not as a plaintiff or class representative or member or otherwise on behalf of others in any purported class, collective, or representative proceeding. The client also agrees that only original documents will be allowed in court.
